In the Past
In actions of assumpsit, it is usual to put in a count, commonly called a common count, for work and labor done and materials giveed by the plaintiff for the defendant; and when the work was not done under a special contract (see more about this popular legal topic in the U.S. encyclopedia), the plaintiff will be entitled to recover on the common count for work, labor and materials. 4 Tyr.
